£6,000 SEND Notional Budget: How does it work?
The law requires that Local Authorities (LAs) provide sufficient funding so that schools can fund SEND provision up to £6,000 per pupil per annum.
Sadly, we know that few, if any, LAs actually do this. In fact, many LAs are telling schools they need proof of spending over the £6,000 threshold before the LA will even consider a request for an Education Health Care (EHC) needs assessment or further SEN support.
The issue is that this threshold is, according to the School Standards and Framework Act and the Department for Education’s Call for Evidence 2019, a requirement of LAs, NOT of schools and other settings.
Garry Freeman is calling on schools to challenge LA officers every time they specify such a “requirement”
and emphasise that in fact the law requires the LA to fund up to £6,000 and not schools!

Garry has also recorded a session on SEND Law in Practice: EHCP Process in which he clarifies the Education, Health & Care Plan processes in England.
In this presentation Garry takes you through the processes and gives you:
- A working understanding of the main aspects of SEND funding as it applies in England
- Confidence and insight to discuss these aspects and challenge Local Authorities/professionals where appropriate
- The knowledge and references to inform work done by parents/professionals
- An understanding that SEND funding per child/young person is the responsibility and a requirement of the Local Authority
Is your school struggling with its SEND budget?
Major success with 1 EHCP in 1 London borough!
LA wrote on Plan: “School must contribute the first £6,000 from its own resources”
Garry Freeman: To Case Worker, Manager & Director of Children’s Services. This is unlawful, contrary to funding law (quoted verbatim). It must be removed, possible Judicial Review.
LA: Thank you. We will check
LA: It will be removed.
